Cancellation Policy
Term and Termination
The Jolly Marketer Subscription has a term of 3 months, starting from the date of your first monthly fee payment (the binding Start Date). However, you can cancel at any time during the 3-month term thanks to a flexible 24-hour break clause. This clause allows termination of the subscription with just 24 hours’ notice, effective immediately from the Start Date.
The Subscription Term will be automatically renewed for additional periods of 3 months unless either party opts for termination.
All terminations or pauses of the Jolly Marketer Subscription, including those invoked under the 24-hour break clause, must be executed in writing. The obligation to provide a 24-hour notice for termination must also be fulfilled in written form, ensuring that the intention to terminate is clearly documented and communicated within the designated notice period.
Definitions
- “Service” refers to all products, subscriptions, and consulting services provided by Jolly Marketer.
- “Subscription” is a recurring plan billed periodically that grants access to the Service.
Fees and Payment Terms
Service Fees
The Service Fees are plus statutory VAT (if applicable).
Payment
Jolly Marketer Service Fees are invoiced monthly upfront. Campaigns only launch after payment has been received by Jolly Marketer. Payment methods include credit card, PayPal, and bank transfer.
Users must provide accurate billing information, including full name, address, and valid payment method details. In the event of a failed payment, an electronic invoice will be issued for manual payment within the stated deadline.
Refund Policy
Except where required by law, all paid fees are non-refundable.
Account Creation and Responsibility
If an account is required to use the Service:
- Users must ensure that the information provided is accurate, complete, and current.
- Users are responsible for maintaining the confidentiality of account credentials and for all activities conducted under their account.
Intellectual Property
The Service and its original content, features, and functionality are the exclusive property of Jolly Marketer. The content is protected by copyright, trademark, and other intellectual property laws.
Indemnification
Users agree to defend, indemnify, and hold harmless Jolly Marketer and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including attorney’s fees) arising out of:
- Use of the Service.
- Breach of these Terms.
Limitation of Liability
Jolly Marketer is not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits or data. Liability is limited to the amount paid for the Service.
Errors and Inaccuracies
Jolly Marketer does not guarantee the accuracy or completeness of information related to the Service. Jolly Marketer reserves the right to correct errors and update information without prior notice.
Third-Party Links
The Service may include links to third-party websites or services. Jolly Marketer is not responsible for the content, policies, or practices of third-party sites.
Changes to Terms
Jolly Marketer reserves the right to modify or replace these Terms at its sole discretion. Users will be notified of material changes at least 30 days before new terms take effect.
